  • How do I submit a request to the Boyd County Detention Center (Jail)?
    • Per the Jailer, All requests must be submitted per their policies and procedures, located at: https://boydcountyjail.com/make-an-open-records-request
    • No requests through this portal for the Detention Center will be honored. For more information regarding this policy, please contact the Detention Center at 606-739-4224.

  • How long will my request take?
    • Your request response time will vary based on the type and size of your request, some requests may take several business days to complete, the department your request is routed to will inform you of the estimated time to process once your request has been submitted,

  • Will my request be published?
    • Yes, as part of Judge Chaney's commitment to transparency, all open records requests, which are open records their selves, will be published and publicly viewable on this portal, whether your request is approved or not, Your request, as well as the documents or records you requested, will be available for public view. If you have an objection to the publication of your request, or it's contents, you may contact our office at 606-739-4134.

  • I am a member of the media, submitting a request.
    • All media Open Records Requests shall comply with Kentucky Revised Statues 61.870 to 61.884, and KRS 189.635. Any member of the media making a request in compliance with the applicable KRS shall complete the "Certification of News Gathering Organization" form, and submit with their request. If your request is not for news gathering purposes, but instead a commercial request, your request must include a Commercial Use Certification form. which may be found here.

  • I want to submit an anonymous request.
    • The Boyd County Government does not accept Anonymous requests for public records. All requests shall comply with Kentucky Revised Statues 61.870 to 61.884, and specifically KRS 61.870 (10(a) to (f).
    • Public records of this agency shall be made available to a resident of the Commonwealth as defined in KRS 61.870, and upon written application signed by the applicant, with his or her name printed legible on the application, describing the record(s) to be inspected. The applicant is required to provide a statement in the written application, of the manner in which the applicant is a resident of the Commonwealth under KRS 61.870 (10(a) to (f), 22-ORD-122.

  • My request was denied, why?
    • Reasons for denial vary by request and circumstances, your specific reason was provided to you on the response from the department whom denied the request. If you feel your request denial was unfair, or was in error, You may re-submit your request with an appeal, please state your appeal reason, and any evidence supporting your appeal, you may also appeal to the Kentucky Attorney General's office, In accordance with KRS 61.880.

  • My request was denied due to "Commercial Use", why?
    • If your request was submitted and determined to be commercial in nature, and you did not include a certification of commercial use, your request can be denied. Per KRS 61.874(5)(a)(c);
    • It shall be unlawful for a person to obtain a copy of any part of a public record for a: (a) Commercial purpose, without stating the commercial Purpose, if a certified statement from the requestor was required by the public agency pursuant to subsection (4)(b) of this section; or (b) Commercial purpose, if the Person uses or knowingly allows the use of the public record for a different commercial purpose; or (c) Noncommercial purpose, if the person uses or knowingly allows the use of the public record for a commercial purpose. A newspaper, periodical, radio or television station shall not be held to have used or knowingly allowed the use of the public record for a commercial purpose merely because of its publication or broadcast, unless it has also given its express permission for that commercial use.
    • KRS 61.870(4) defines "commercial purpose" as "the direct or indirect use of any part of a public record or records, in any form, for sale, resale, solicitation, rent, or lease of a service, or any use by which the user expects a profit either through commission, salary, or fee."

  • I made a large or broad request and it was denied, why?
    • "Blanket requests for information on a particular subject, without a specification of the documents that are desired need not be honored." KY OAG 85-107
    • In order to efficiently and promptly process requests, we ask that all requests be as specific as possible for the documents or records you are seeking. Requests that are unreasonably burdensome, or intentionally large or broad, with the intention of disrupting the essential functions of a government office, may be denied per KRS 61.872(6).

  • My request was closed due to inactivity or no response, why?
    • Sometimes requests require clarification from the requestor. We will in some cases send a response through this portal, requesting additional information, or to ask that you narrow a broad request. If no response is received within 3 business days, your request may be closed due to lack of response. If you feel this was done in error, please open a new request.
